“WINE SELECTORS 35 YEARS PRIZE DRAW” PROMOTION
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents (excluding NT) aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Promotion commences at 12:00am AEDST on 22/02/10 and final entries close at 11:59pm AEST on 27/06/10 (“Promotional Period”).
- To enter, individuals must, during the Promotional Period either:
- Receive the promotional email, then click on the link provided in the promotional email, fully complete the entry form provided and submit during the Promotional Period;
- Complete the official entry form found at a promotional stand advertised at various locations during the Promotional Period and place in the entry box provided at the promotional stand during the Promotional Period. A list of promotional stand locations can be found at www.wineselectors.com.au;
- Send an SMS to 1999 3999 containing their full name and state, in that order with a space between each piece of information (e.g. John Smith NSW) during the Promotional Period. Premium SMS cost is 55c. Entrants must have premium service access. SMS helpline:1800 205 596; or
- Visit www.wineselectors.com.au, follow the prompts to the competition entry page, input the requested details and submit the fully completed entry form during the Promotional Period.
- Individuals who enter via method (d) above will have the opportunity to receive one (1) additional entry for each friend they refer to the competition. To do so, entrants must, once entry is complete, provide their friends unique and valid email address. Each referred friend will then receive a promotional email from the Promoter inviting them to enter. For every referred friend that enters the competition via clicking the link in the promotional email and entering the requested details, the initial entrant will receive one (1) additional entry. Entrants warrant that: (a) the individual that they intend to refer the competition to is an Australian resident (excluding NT) aged 18 or over who would normally consent to receiving emails from the entrant; and (b) the friend’s name and unique email address provided is valid. Entrants may only refer the competition to a friend’s unique valid email address once.
- Incomplete, indecipherable or illegible entries will be deemed invalid.
- Multiple entries permitted, subject to the following: (a) only one (1) initial entry permitted per person; and (b) only one (1) additional entry for each successfully referred friend.
- SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
- There will be four (4) Minor Draws and one (1) Major Prize Draw for this promotion. Entries for each draw open at 12:00am and close at 11:59pm on the dates specified in the table below. All draws will take place at 3:00pm at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards, NSW 2065 on the dates specified in the table below. All entries prior to a Minor Draw close date will be entered into that Minor Draw as well as the Major Prize Draw. Entries in each Minor Draw will NOT be entered into any subsequent Minor draws but will be entered into the Major Prize Draw. Winners will be notified via phone and in writing and their names will be published in The Australian on the dates specified in the table below. All times indicated are AEDST/ AEST depending on the date. The Promoter’s decision is final and no correspondence will be entered into.

- The first valid entry drawn in each Minor Draw will win thirty five (35) bottles of premium wine. Prize valued at $542.00. - The first valid entry drawn in the Major Prize Draw will win thirty five (35) bottles of iconic wine. Prize valued at $5,013.00. Bottles of iconic wine will include the following labels: 1 x Cullen 1999; 2 x Draytons Joseph 1991; 1 x Grant Burge Shadrach 1996; 2 x Grosset Gaia 1999; 2 x Eileen Hardy 2002; 1 x Eileen Hardy 2000; 2 x Henschke Hill of Grace 2005; 1 x Houghton Jack Mann 2000; 2 x Art Series 1999; 2 x Lindemans Limestone Ridge 1991; 2 x McWilliams Liq Gold NV; 1 x Moss Wood 2003; 2 x Moss Wood 1999; 2 x Penfolds RWT 2004; 1 x Penfolds Bin 707 1997; 2 x Pol Roger NV; 1 x Penfolds Magill 1993; 2 x Penfolds RWT 2005; 2 x Penfolds Grange 2001; 2 x Pierro 2000; and 2 x Wynns Michael 1997.
- No more than 20 litres of alcohol will be won by New South Wales residents. Once 20 litres of alcohol has been won by New South Wales residents, Schott Zwiesel Red Wine Classico Crystal Glasses will be awarded in lieu of the remaining value of any Minor Draw prize and Liebherr WK 1802 Wine Cellar and Schott Zwiesel Red Wine Classico Crystal Glasses will be awarded in lieu of the remaining value of the Major Prize.
- The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is $7,181.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any unclaimed prizes may take place on 08/10/10 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 15/10/10.
- Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
- The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
