TERMS AND CONDITIONS

 

  1. Information on how to enter and details of the Prizes (defined below) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. Promotion commences at 12:00am AEDST on 19/02/2018 and final entries close at 11:59pm AEST on 15/04/2018 (“Promotional Period”).
  4. To be eligible to enter, individuals must purchase from Wine Selectors one (1) bottle of either Cobram Estate 500ml Hojiblanca Reserve Extra Virgin Olive Oil 2017 (Item Code: COBRA60117) OR/AND Cobram Estate 500ml Picual Reserve Extra Virgin Olive Oil 2017 (Item Code: COBRA61117) in a single transaction (“Qualifying Transaction”). Purchases of the Cobram Extra Virgin Olive Oil can be made with or without wine packs. Qualifying Transactions can be made online at www.wineselectors.com.au (“Website”), over the phone, at authorised airport cellar door locations, via mail or via fax (see the Website for full details on purchase options). For the removal of doubt, individuals only need to purchase one (1) bottle of Cobram Estate in order to be eligible to enter.
  5. To enter, individuals must then either opt in at the point of purchase online by ticking the box available or by specifying to a call centre agent or cellar door agent that they would like to enter the promotion once they are deemed eligible. For Qualifying Transactions made via mail or fax there will be an opt in tick box for entry into the promotion on the order form. 
  6. Incomplete, illegible or indecipherable entries will be deemed invalid.
  7. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the number of bottles of Cobram Estate purchased in that transaction); and (b) each entry must be submitted separately and in accordance with entry requirements.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  10. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 18/04/2018 at 10:00am AEST. The winners will be notified via phone and in writing within two (2) business days of the draw. The winners’ names will also be published online at https://www.wineselectors.com.au/competitions/competition-winners from 20/04/2018. In the event a winner is from SA, their name(s) will also be published in The Advertiser on 25/04/2018. Anisimoff Legal, on behalf of the Promoter, may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
  11. The Promoter’s decision is final and no correspondence will be entered into.
  12. The first four (4) valid entries drawn will each win a trip for two (2) adults to Cobram Estate (8533 Murray Valley Highway Boundary Bend, Victoria, 3599) on Monday 07/05/2018 valued at  $3,500 (each a “Prize”). Each Prize includes the following:
    • Private flight (owned by Cobram Estate) from Sydney Airport to Boundary Bend Olive Grove.
    • A day tour of Cobram Estate including a tasting and lunch;
    • $500 deposited into each winner’s bank account for travel costs to and from Sydney Airport. The winner will need to cover any additional costs that exceed this amount. For the removal of doubt, winners and their travel companions must organise their own way to and from Sydney airport.
  13. Spending money, additional meals, insurance and all other ancillary costs are not included. All elements of the Prize are subject to availability at time of booking. Prize must be taken on Monday 07/05/2018. If for any reason a winner is not able to take the prize on the above date, then the Prize will be forfeited without further compensation. All activities must be redeemed at once (i.e. on Monday, 07/05/2018). Winners cannot change the activities of the Prize. Winner and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers.

All other costs associated with the Prize will be the responsibility of the Prize winner. Flights to and from Sydney Airport are not included as part of the Prize and will be the responsibility of each winner and his/her companion. Winners and their companions will board a Pilatus PC-12 private plane for their trip to and from Sydney Airport and Boundary Bend Olive Grove. Travel insurance is not included in the prize and remains the responsibility of the winners and their companions.

  1. Should the winner not have an additional guest, the remaining value of the Prize will be forfeited and not exchanged for cash or additional prize value.
  2. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.
  3. Subject to the unclaimed prize draw clause, if for any reason a winner does not take or claim the Prize (or an element of the Prize), by the date and time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
  4. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  5. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
  6. Total maximum prize pool value for the prize is $14,000. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in Prize value between now and the date on which the Prize is taken. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  7. It is a condition of accepting the Prize that the winners and their companions must comply with all the conditions of use of the Prize and the Prize Sponsor’s requirements.
  8. A draw for any unclaimed Prizes may take place on 30/04/2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winners, if any, will be notified via phone and in writing within two (2) business days of the draw. The winners’ names’ (if awarded in the unclaimed prize draw) will also be published online at https://www.wineselectors.com.au/competitions/competition-winners from 02/05/2018. In the event of a winner from SA, their name(s) will also be published in The Australian newspaper on 04/05/2018.
  9. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  10. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  11. Any cost associated with accessing the promotional website or the Internet in relation to this promotion is the entrant’s responsibility and is dependent on the Internet service provider used.
  12. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  13. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Prize value to that stated in these Terms and Conditions; (e) if a promotional stand is not present or is relocated for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of the Prize (or part of the Prize).
  14. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.wineselectors.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia.
  15. As a condition of accepting the Prize, the winner and his/her companions must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  16. The Promoter may also disclose entrant’s PI to Cobram Estate Pty Ltd of Unit 14, 75 Lorimer Street, Southbank, VIC. 3006 Australia (“Prize Sponsor”). The Prize Sponsor may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Prize Sponsor’s Privacy Policy contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. To view the Prize Sponsor’s Privacy Policy, see https://cobramestate.com.au/policies. The Prize Sponsor will not disclose entrant’s PI to any entity outside of Australia. The Promoter will not share an entrant’s PI with the Prize Sponsor if entrant has opted out.
